Terms of Service
Version 3.0 · Effective August 6, 2026
Welcome to toska. By creating an account or using the app, you agree to these terms. If you don't agree, please don't use toska. Section 14 requires most disputes to be resolved by binding individual arbitration and waives class actions and jury trials — please read it carefully. You may opt out of arbitration within 30 days.
1. What toska is
toska is a pseudonymous platform for expressing feelings about breakups and loss. You post under a randomly generated handle, not your real name. toska is operated by SALTE DEVELOPMENT LLC, a single-member company — please read the liability and availability sections with that in mind.
2. Who can use toska
You must be at least 18 years old to use toska. By creating an account you confirm this, and your confirmation is recorded. We do not knowingly allow anyone under 18 to use the app, and we remove accounts we discover to be underage. In the few states where the age of majority is above 18 — Alabama and Nebraska (19) and Mississippi (21) — you confirm that a parent or legal guardian has reviewed and agreed to these terms on your behalf; everywhere else, being 18 means you can agree to them yourself.
3. Your account
You're responsible for your account and for all activity under it, and for keeping your sign-in method secure. You can add a backup sign-in method in Settings. If you believe someone accessed your account, change your password or contact us. You may not share, sell, or transfer your account.
4. Zero tolerance for objectionable content and abusive users
There is no tolerance on toska for objectionable content or abusive behavior. We may remove content, restrict accounts, or terminate accounts — with or without notice, and in our sole discretion — for violations of section 5. We review every report and aim to act within 24 hours. This section exists because we mean it, and because Apple's guidelines for user-generated-content apps require it; the app provides in-app reporting, user blocking, and content removal, and we use them.
5. What you may not post or do
toska is for honest emotional expression. You may not:
- target, harass, threaten, or bully any person;
- write letters or posts directed at real, identifiable people in a way that identifies them — the "letters" feature is for words you never sent, not for naming names. Content that identifies a real person (name, handle, workplace, or enough detail to identify them) will be removed;
- share anyone's personal information (doxxing) — names, addresses, phone numbers, emails, social handles, or other identifying details, whether the person is on toska or not;
- post sexually explicit content, or any content involving minors;
- encourage or instruct self-harm or suicide (expressing your own pain is allowed and expected here — instructions and encouragement are not);
- promote violence or illegal activity;
- spam, advertise, post links, use bots, or scrape the service;
- impersonate anyone or misrepresent your affiliation;
- attempt to identify, deanonymize, or "out" another user;
- interfere with the service, probe or test its security, circumvent App Check or rate limits, reverse-engineer the app except to the limited extent mandatory law permits, or access data or accounts you're not authorized to access.
Automated systems screen content at posting time and may hold content for human review before or after it appears. Human moderators make final calls.
6. Reporting, blocking, enforcement
You can report any post, reply, or user in-app, and block any user (the blocked person is not notified). Blocking hides each of you from the other's profile and stops all interaction between you — replies, likes, reposts, follows, and notifications — in both directions. One honest limit: it does not remove your posts from the public feed, so someone you've blocked can still read what you post there. We may remove content, hold it for review, restrict an account's ability to post, or terminate an account, at our discretion. Serious threats of harm may be referred to law enforcement.
7. Your content and the license you give us
You own what you write. So we can run the app, you grant us a non-exclusive, worldwide, royalty-free, sublicensable (only to our infrastructure providers acting on our behalf) license to host, store, display, reproduce, and distribute your content within the toska service — feeds, threads, search, and notifications. You represent that you have the rights to the content you post and that it does not violate these terms or any law or third-party right.
Two narrower, optional uses are controlled by your "allow sharing" setting (on by default, off any time in Settings → Privacy):
- Share cards: other users may render one of your posts as a shareable image. The card carries the words and feeling tag only — never your handle or any account identifier.
- Website featuring: we may hand-pick a small number of posts to display on toskaapp.com and its share pages, again without your handle or any identifier.
Turning "allow sharing" off ends both uses, including for existing posts. Deleting a post ends all uses of it. We claim no other rights — no advertising use of your content, no sale of your content, and no use of your content to train AI models (ours or anyone's). The license for a piece of content ends when you delete it or delete your account, except for copies in reports/moderation records where content was reported, and short-lived backups (section 12).
8. Expiring posts — what "disappears" actually means
Whisper posts and midnight posts are ephemeral by design, and we want to be precise about the mechanics:
- The moment a post expires (1 hour after posting for whispers; your local midnight for midnight posts), it stops appearing in every feed and surface in the app.
- The post is then permanently deleted from our live database, usually within about ten minutes of expiring, by an automated cleanup that runs every ten minutes (with a database time-to-live policy as backstop, which can take longer if a cleanup run fails).
- Like all data, deleted posts can persist briefly in standard database backups (section 12) before those backups expire.
- Practical honesty: anything shown on screens can be screenshotted by other users before it expires. Expiration limits how long we keep and show a post; it cannot un-show it to people who already saw it.
9. toska is not a crisis service
toska is not therapy, medical care, or a crisis service, and nothing in the app is professional advice. If you are in crisis or thinking about harming yourself, contact the 988 Suicide and Crisis Lifeline (call or text 988) or the Crisis Text Line (text HOME to 741741) in the US, or your local emergency number. The app surfaces crisis resources when its systems detect distress language, but detection is imperfect, resources vary by region, and no one monitors the app around the clock. Do not rely on toska for emergency help. To the fullest extent permitted by law, we are not liable for any act or omission relating to crisis detection, moderation timing, or another user's conduct.
10. Account deletion
You can delete your account any time in Settings. Deletion removes your profile, posts, replies, likes, saves, drafts, notifications, and personal data through an automated cascade that begins immediately (see the Privacy Policy for exact scope and the backup window). Deletion is permanent. We may also suspend or terminate your account, and your right to use toska ends immediately, if you violate these terms or if we discontinue the service.
11. Availability; disclaimers of warranty; other users
toska is run by a very small team. We do our best, but: the service and everything in it are provided "as is" and "as available", with all faults, and we disclaim all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the service will be uninterrupted, timely, secure, error-free, or free of harmful components, that defects will be corrected, that content is accurate, or that data will never be lost — keep your own copies of anything important (Settings → export my data). Other users' content and conduct are not ours: toska hosts user-generated content and interactions, and we do not endorse, verify, or take responsibility for what other users post or do, and we are not a party to disputes between users; your interactions with other users are at your own risk. We may change, suspend, or discontinue any part of the service at any time and are not liable for doing so. We are not liable for any failure or delay caused by events beyond our reasonable control (force majeure).
12. Backups
We keep standard database backups for disaster recovery: point-in-time recovery for 7 days, daily backups kept 7 days, weekly backups kept 8 weeks. Deleted content and deleted accounts fall out of all backups as those backups expire — at most about 60 days after deletion. Backups are only used to restore the service after a failure; we do not restore individually deleted content from them.
13. Limitation of liability; indemnification; release
Assumption of risk. toska is a space where people share raw, painful, unverified feelings and interact with strangers. You use it, and read and respond to others' content, at your own risk.
Limitation of liability. To the fullest extent permitted by law: neither SALTE DEVELOPMENT LLC nor its member, officers, contractors, or suppliers will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or emotional distress, arising out of or relating to toska or these terms, on any theory (contract, tort including negligence, strict liability, or otherwise), even if advised of the possibility; our total aggregate liability for all claims will not exceed the greater of US $100 or the amount you paid us in the 12 months before the event (currently $0 — toska is free); and these limits apply even if a remedy fails of its essential purpose. Some jurisdictions don't allow some of these limits, so parts may not apply to you.
Indemnification. You will defend, indemnify, and hold harmless SALTE DEVELOPMENT LLC and its member, officers, and contractors from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to content you post, your use of toska, your violation of these terms or any law or third-party right, or your interactions or disputes with any other user. We may assume the exclusive defense and control of any indemnified matter, and you will cooperate.
Release. Because we are not a party to disputes between users, you release SALTE DEVELOPMENT LLC and its member, officers, and contractors from any claims and damages of every kind arising out of any dispute with another user or the content or conduct of any other user. California residents waive Civil Code § 1542.
14. Governing law; dispute resolution; arbitration
These terms and any dispute are governed by the laws of the State of Texas, without regard to conflict-of-law rules, and, as applicable, the Federal Arbitration Act.
Informal resolution first. Before starting arbitration or a lawsuit, email us at salte@saltedevelopments.com and give us 30 days to try to resolve it informally.
Binding individual arbitration. If we can't resolve it informally, you and we agree that any dispute arising out of or relating to toska or these terms (except the carve-outs below) will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. Judgment on the award may be entered in any court with jurisdiction.
Fees and location. The AAA Consumer Arbitration Rules govern filing, administrative, and arbitrator fees, and we will pay those fees to the extent the rules require and to the extent necessary to prevent the arbitration from being cost-prohibitive for you. Any in-person hearing will take place in the county where you live or another mutually convenient location, and the arbitration may also proceed by phone, video, or written submissions. Each party otherwise bears its own attorneys' fees except where a statute or the arbitrator provides otherwise.
Class-action and jury-trial waiver. Claims may be brought only in an individual capacity, not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding, and you and we waive any right to a jury trial.
30-day opt-out. You may opt out of this arbitration agreement (including the waivers) by emailing salte@saltedevelopments.com with the subject "Arbitration Opt-Out" within 30 days of first accepting this version. Opting out doesn't affect the rest of these terms.
Carve-outs. Either of us may bring an individual claim in small-claims court if it qualifies, and either may seek injunctive or equitable relief in court for infringement or misuse of intellectual property or unauthorized access to the service. These are not subject to arbitration.
Severability and fallback. If the class-action waiver is found unenforceable as to a claim, that claim proceeds in court. If the arbitration agreement is found unenforceable or doesn't apply (for example, to a minor's claim a court declines to enforce), or if you opt out, disputes are resolved exclusively in the state or federal courts in Dallas County, Texas, and you consent to their jurisdiction and venue.
One-year limitations period. To the extent permitted by law, any claim must be brought within one (1) year after it arises, or it is permanently barred.
15. Changes to these terms
We may update these terms at any time, in our sole discretion. Each version has a number and date. If we make material changes, the app will show you the new version and ask you to accept before you continue using toska; your acceptance (version and timestamp) is recorded on your account. Non-material changes take effect when posted, and your continued use of toska means you accept the current terms. If you decline a material change, you'll be signed out — your account and content are kept so you can return and accept later, or delete your account.
16. Apple App Store terms
You get toska through the Apple App Store, and Apple's Standard Licensed Application End User License Agreement also applies to your license of the app; to the extent these terms conflict with the Apple EULA regarding that license, the Apple EULA governs. Apple is not responsible for the app or its content, has no obligation to provide support or maintenance, is not responsible for addressing any product-liability, legal, or regulatory claims regarding the app, and is a third-party beneficiary of these terms with the right to enforce them.
17. General
If any provision is unenforceable, it is severed and the rest remain in effect. Our failure to enforce a provision isn't a waiver, and a waiver in one instance is not a waiver in another. These terms plus the Privacy Policy and the Apple EULA are the entire agreement between you and us about toska and supersede any prior agreement or understanding; you confirm you have not relied on any promise, representation, or statement not expressly contained in these terms. You may not use toska where prohibited by law, and you are responsible for complying with your local laws. You may not assign these terms; we may assign them in connection with a merger, acquisition, reorganization, or sale of assets, and the Privacy Policy governs what happens to data in that event. Sections that by their nature should survive termination (including 7, 9, 11, 13, 14, and 17) survive.

If your content was removed by mistake or misidentification, you may send a counter-notification with the elements required by 17 U.S.C. § 512(g) to the same address, and we will follow the statutory counter-notice process.
